Night work calculator

Enter the time you started work after your rest. The calculator tells you whether the shift touches the 0:00–5:00 window, how late you can work without going over 10 hours and when the normal rules apply again after the next rest.

The values are stored only on this device.

Indicative tool. It applies Articles 22 and 23 of Portuguese Decree-Law 84/2026 (in force since 12 July 2026), which transposes Directive 2002/15/EC. In other countries the night window may differ: the directive lets each State set at least 4 hours between 0:00 and 7:00. Driving times and breaks under Regulation (EC) No 561/2006 still apply — for those, use the day calculator. Rest periods follow Article 8 of the same Regulation, for a single driver only. Clock changes are not taken into account.

        What the law says

        One minute is enough

One minute of work between 0:00 and 5:00 is enough for the shift to count as night work. Then all the work in the shift — driving, loading, unloading, refuelling, cleaning, overtime — is capped at 10 hours.

24 hours, not the calendar day

The 10 hours count within the 24 hours from the start of the shift, which begins after a daily or weekly rest. A shift from 22:00 to 7:00 is a single night shift, not two days. The next rest does not reset the count: whatever you work before the 24 hours are up still counts towards the 10.

        Availability does not count

Ferry or train, border, the time next to the driver in a team and waits whose duration is known in advance are not counted in the 10 hours (Art. 22(2)). Waiting with no expected time is work.

Breaks and 6 hours in a row

Over 6 hours of work, a 30-minute break; over 9, 45 minutes, in blocks of at least 15. Never more than 6 hours of work in a row (Art. 23).

        Fines

Going over 10 hours is minor up to 11, serious from 11 to 13 and very serious from 13 (Art. 22(4)). As a rule the company is liable, unless it proves it organised the work so the driver could comply.

        Collective agreement

For technical or work-organisation reasons, a collective agreement can set aside the 10-hour cap (Art. 22(3)). Check the one that applies to your company.
